Terms & Conditions
Applicable to Group Tours, Hikes, Retreats, Day Events, and Membership Experiences
Luscious Outdoors Africa ("LOA", "we", "us", or "our") offers curated outdoor experiences focused on wellness, nature, and community. These Terms & Conditions outline the responsibilities and expectations between you (the participant/client) and LOA.
1. Membership & Experience Access
Membership provides access to walks available in your membership and facilitation
Experiences are structured outdoor group activities published in the monthly calendar
Access to sessions is subject to availability and active membership status
Transportation, food, and park/entry fees are not included unless explicitly stated per event
2. Cancellations by You – Day Events, Overnight Trips & Retreats
All payments made to Luscious Outdoors Africa (LOA) are non-refundable
You may request a credit transfer to a future LOA experience, valid for 6 months from the original event date
Credit transfer requests must be submitted in writing at least:
7 days before a day event
3 months before an overnight trip or retreat
Only one transfer is allowed per booking
If the future event has a higher price, the participant is responsible for covering the difference
3. Replacement Option
You may nominate someone else to attend in your place at no additional cost
You must notify us in writing
Full participant details must be submitted at least 48 hours before the event
The replacement agrees to all applicable Terms & Conditions
Once transferred, all booking terms apply to the new participant
4. No-Show & Late Cancellations
No-shows or cancellations after the transfer deadline result in forfeiture of the booking
No refunds or credits will be issued
Missed portions of any experience (including late arrival or early departure) are non-refundable and non-transferable
Travel insurance is strongly recommended for personal protection
5. Cancellations or Changes by LOA
LOA reserves the right to cancel or reschedule any event due to:
Insufficient participant numbers
Force majeure events (including but not limited to natural disasters, government restrictions, pandemics)
Operational challenges beyond our control
In such cases:
Participants will receive a full refund or credit unless funds have already been committed to third-party providers
Postponed events will remain valid as credit for future use and will not expire within the 6-month validity period
LOA is not liable for external costs incurred (transport, accommodation, gear, visas, insurance, or preparation expenses)
Refunds, where applicable, will be processed within 60 days
6. Health, Safety & Participation
LOA reserves the right to deny or remove any participant whose behavior endangers themselves or others
Participants must disclose any relevant medical or physical conditions
Participation is at the individual’s own risk
LOA is not liable for injury, illness, or death during outdoor activities
Participants are encouraged to review relevant health and travel advisories before attending
7. Age & Participant Responsibility
Minimum age for participation is 13 years, unless part of a private or family group
Participants are responsible for:
Arriving on time
Being physically and mentally prepared
Bringing appropriate gear and supplies
8. Photography & Media Consent
By participating in LOA events, you consent to photography and video recording for promotional use
If you do not wish to appear in media, you must inform the host in advance and avoid group photo participation
9. Conduct & Participant Expectations
Respect nature, communities, and fellow participants
Follow all facilitator instructions at all times
Refrain from abusive, unsafe, or disruptive behavior
LOA reserves the right to remove any participant without refund for misconduct
10. Third-Party Providers
LOA works with selected third-party providers including transport, accommodation, and facilitators
LOA is not responsible for delays, disruptions, or incidents caused by third parties
Third-party services are subject to their own terms and local regulations
11. Limitations of Liability
LOA is not responsible for losses, injuries, or delays resulting from:
Natural disasters
Government actions, strikes, or unrest
Personal negligence, theft, or accidents
Inherent risks of outdoor activities (including wildlife, terrain, weather, and water-based environments)
Limited access to medical services in remote areas
12. Complaints & Disputes
Concerns should be raised during the event for immediate resolution where possible
Written complaints must be submitted within 7 days of the event
All disputes are governed by the laws of Kenya
