Acknowledgment of Risk

I, the undersigned, hereby affirm and acknowledge that my participation in any and all activities organized by Luscious Outdoors Africa, including but not limited to:

• Hiking & trekking
  
  

• Wellness retreats & picnics
  
  

• Cycling events
  
  

• Outdoor adventures & trips
  
  

is voluntary and entirely at my own risk.

I fully understand and accept that participating in these activities involves risks, including but not limited to:

• Physical injury or illness
  
  

• Loss or damage to personal property
  
  

• Extreme weather conditions & terrain hazards
  
  

• Wildlife encounters
  
  

• Accidents due to my own actions or those of others
  
  

Waiver of Liability & Indemnity

By signing this agreement, I agree to:

• Release, indemnify, and hold harmless Luscious Outdoors Africa, including its employees, guides, affiliates, and partners, from any and all claims, lawsuits, or demands arising from my participation in these activities.
  
  

• Assume full responsibility for any injury, death, or damage to personal property that may occur during any event.
  
  

• Waive any legal action against Luscious Outdoors Africa in the event of personal injury, loss, or other damages, except in cases of proven gross negligence.
  
  

• Cover all legal costs incurred by Luscious Outdoors Africa if I, my heirs, or any legal representative initiate legal proceedings and the company successfully defends such action.
  
  

Medical Fitness & Emergency Care

• I declare that I am in good health and physically capable of participating in outdoor activities.
  
  

• I confirm that I have no medical conditions that could interfere with my participation.
  
  

• In case of a medical emergency, I authorize Luscious Outdoors Africa to:
  
  

• Provide first aid and arrange emergency medical transport if needed.
  
  

• Seek medical attention on my behalf, understanding that I am responsible for any medical expenses incurred.
  
  

Legal Considerations

Severability Clause

If any part of this agreement is found to be invalid or unenforceable, the remaining provisions will continue in full effect. Any invalid provision will be modified to the extent necessary to align with the intent of this agreement.

Jurisdiction & Applicable Law

This waiver is governed by the laws of Kenya, and any disputes shall be resolved within Kenyan courts.

Final Acknowledgment

I confirm that I have carefully read, understood, and voluntarily agreed to this Waiver and Indemnity Agreement before participating in any Luscious Outdoors Africa event.
